A federal judge in Connecticut has granted Pfizer’s request to stop a drug company from selling Lamisil Once (terbinafine) in the United States, a drug that’s been approved by the Food and Drug Administration (FDA) for use in people with rheumatoid arthritis (RA) and osteoarthritis (OA). The FDA rejected a class-action lawsuit alleging that the company, Pfizer, violated the Hatch-Waxman Act.
Pfizer’s lawsuit, filed Monday in Connecticut District Court, was filed by the defendants, namely GlaxoSmithKline, its largest generic manufacturer, in October 2019 and GlaxoSmithKline in October 2020. The lawsuit alleges that the FDA approved the drug in January 2020 for use in patients with RA and OA, as well as in patients with rheumatoid arthritis, osteoarthritis, and mild to moderate pain.

The lawsuit claims that the FDA has determined that the drug’s safety and efficacy are not affected by the drug’s price increase to $1.6 million.
Pfizer has denied that it had the drugs’ safety and efficacy, claiming that it has “no involvement” in the drug’s price increase and that it “is not involved in the FDA approval process or any other decision regarding the use of this drug.”
The company has denied the claim in the lawsuit. In April 2020, the FDA granted approval for generic Terbinafine, which is available on the US market under the generic name of Lotrimin. The FDA also approved it for use in patients with RA, OA, and mild to moderate pain.
The suit seeks an injunction to protect the FDA from selling the drug, a request that Pfizer submit additional information to the agency and to the FDA in the future, a request that the agency send a letter to the FDA informing it of the pending suit, and a request to the FDA to continue the drug’s approval for use in patients with RA and OA.
Pfizer has not responded to an earlier request for comment.
The suit also asks that Pfizer discontinue the use of the drug and stop selling it after the FDA approved it, and also ask the FDA to stop selling the drug.
